Acceptance of Terms

By accessing or using the KlingCorp website ("Site") or any KlingCorp product, including FenixCore (collectively, "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use our Services.

These Terms apply to all visitors, users, and others who access or use the Services. By using our Services, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

License Grant

Subject to your compliance with these Terms and payment of the applicable license fee, KlingCorp grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use FenixCore solely for your own internal development and production purposes.

Intellectual Property

The Site and all of its content, features, and functionality — including but not limited to text, graphics, logos, code, and software — are owned by KlingCorp and are protected by applicable intellectual property laws.

FenixCore, including its architecture, algorithms, and all associated documentation, is the exclusive intellectual property of KlingCorp. The license granted herein does not constitute a transfer of ownership. All rights not expressly granted are reserved by KlingCorp.

Permitted & Prohibited Uses

You may:

• Use FenixCore in commercial and non-commercial game or simulation projects.
• Modify the source code for use within your own licensed project.
• Reference FenixCore in your project credits.

You may not:

• Resell, sublicense, or redistribute FenixCore or its source code.
• Use FenixCore to build a competing fire simulation product or SDK.
• Remove or obscure any copyright, trademark, or proprietary notices.
• Use our trademarks or brand assets without prior written consent.
• Reverse-engineer any compiled or obfuscated portions of FenixCore.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

KlingCorp does not warrant that (a) the Services will function uninterrupted or error-free, (b) any errors or defects will be corrected, or (c) the Services or any server or network making them available are free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KLINGCORP, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

IN NO EVENT WILL KLINGCORP'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO KLINGCORP FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Sweden.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we do, we will update the "Last Updated" date at the top of this page. We encourage you to review these Terms periodically to stay informed of any changes.

Your continued use of the Services after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Services.
